What is an Uncontested Divorce?

Attorney's commonly call divorces "uncontested" or "contested." These terms are not in any statute books. It is just a way of understanding the posture of a case. An "uncontested" case typically refers to a case that reaches a complete settlement prior to any litigation in court. Usually, it means that the person was not served a petition by a process server. The parties typically reach a settlement, sign a settlement agreement, and then the Petitioner files all the necessary documents, pays the court costs, and schedules an opportunity to have the judge sign a Final Judgment of Dissolution of Marriage. An uncontested divorce can save you a great deal of time, is less costly, and far less stressful.

Statistics and history have shown that not all marriages last. When a couple comes to the decision that their marriage is over, it is usually time for them to file for divorce. In many divorce cases it does not take much for the two parties to work out their differences and come to a relatively amicable agreement as to the terms of their divorce. There is no need for a trial.

In an uncontested divorce there is no need for court litigation. The couple simply makes the mutual decision that the marriage has ended, they hammer out a divorce agreement, have their attorneys finalize the necessary documentation, pay any court fees and go before a judge to have the Final Judgment of Dissolution of Marriage signed.
